Welcome to ZappFiles! These Terms of Service “Terms” govern your use of our platform. By accessing or using ZappFiles, you agree to these Terms. If you do not agree, please do not use our services.

1. General Information

1.1. About ZappFiles

ZappFiles - “we,” “us,” “our” - is a digital file-sharing service operated by Studio Oranje LLC, a limited liability company registered in California. ZappFiles enables users to upload, store, and share files securely over the internet. Our services are accessible through our website, applications, and integrations with third-party platforms.

1.2. Agreement to Terms

By using our services, you confirm that:

  • You are at least 18 years old or have legal consent from a guardian.
  • You agree to comply with these Terms and any additional policies referenced herein.
  • You are responsible for all activity that occurs under your account.

1.3. Changes to Terms

We may modify these Terms from time to time. The updated version will become effective immediately upon being posted on our website. Continued use of our services after changes are made constitutes acceptance of the new Terms.

1.4. Definitions

  • “User” refers to any individual or entity that accesses or uses ZappFiles.
  • “Content” refers to any files, data, or materials uploaded by users.
  • “Services” refers to the ZappFiles platform, including website and applications.

2. Account Registration & Termination

2.1. Creating an Account

  • Users may create an account to access additional features.
  • Users must provide accurate and up-to-date information during registration.
  • Users are responsible for maintaining the confidentiality of their account credentials.

2.2. Account Suspension & Termination

  • ZappFiles may suspend or terminate accounts that violate these Terms.
  • Users may delete their account at any time, but no refunds will be provided.
  • Terminated accounts may result in loss of stored content.

3. User Responsibilities & Content Ownership

3.1. Content Ownership

You retain full ownership of any files you upload to ZappFiles. By uploading files, you grant us a limited, non-exclusive license to store, transmit, and display the content as necessary to operate the platform. We do not claim ownership over your content but reserve the right to remove files that violate our policies or applicable laws.

3.2. Prohibited Content & Conduct

You agree NOT to use ZappFiles for:

  • Illegal activities, including sharing copyrighted or pirated material.
  • Uploading malware, viruses, or malicious software.
  • Sending spam, fraudulent content, or misleading information.
  • Distributing offensive, defamatory, or hate-based content.

4. File Retention & Security

4.1. File Retention Policy

Users can set how long their files remain available before automatic deletion:

  • Free users - no account: Files are stored for up to 10 days.
  • Free users - with account: Files are stored for up to 14 days.
  • Pro users: Files are stored for up to 60 days.
  • Max users: Files are stored for up to 365 days.
  • Enterprise users: Custom file retention periods apply.

No backups are made, and files are permanently deleted after expiration.

4.2. Security Measures

We implement reasonable security measures, including encryption and access controls. However, we do not guarantee complete security, and users are responsible for ensuring the safety of their data.

5. Paid Plans & Subscription Terms

5.1. Subscription Plans

ZappFiles offers three paid plans: Pro, Max, and Enterprise.

  • Pro Plan: Extended file storage - up to 60 days - and password-protected file sharing.
  • Max Plan: Extended file storage - up to 365 days -, higher upload limits, and password-protected file sharing.
  • Enterprise Plan: Custom pricing, retention policies, and advanced features.

5.2. Web Subscriptions (Stripe)

  • Subscriptions purchased via our website are processed by Stripe and accept credit cards or PayPal.
  • Plans auto-renew at the end of each billing period unless canceled in advance from your account settings.
  • Both monthly and annual billing are available; monthly plans cost approximately 25% more per month than annual plans.
  • You may cancel at any time; no refunds are provided for unused portions of the current period.

5.3. iOS Subscriptions (Apple In-App Purchase)

  • Subscriptions purchased through the iOS app are processed by Apple via your Apple ID, in accordance with the Apple Media Services Terms and Conditions.
  • iOS pricing is approximately 20% higher than the web price to cover Apple’s commission. Current iOS prices are $11.99 per month for Pro and $17.99 per month for Max.
  • Subscriptions auto-renew monthly unless canceled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your iOS subscription at any time through Settings → your Apple ID → Subscriptions on your device, or through the App Store. Cancellation takes effect at the end of the current paid period.
  • Refund requests for iOS subscriptions are handled by Apple under their refund policy. Submit requests at reportaproblem.apple.com.

5.4. Cross-Platform Plan Recognition

An active subscription is honored across both the web and iOS applications, regardless of where it was originally purchased, for the same ZappFiles account. To avoid double-billing, please do not subscribe via both platforms simultaneously for the same account.

6. Privacy & Data Protection

ZappFiles collects and processes data in accordance with our Privacy Policy. We use cookies and tracking technologies as outlined in our Cookie Policy.

7. Intellectual Property

All trademarks, logos, and branding associated with ZappFiles are protected under copyright and intellectual property laws. Users may not copy, modify, or distribute our software or branding without permission.

8. Indemnification

Users agree to indemnify and hold harmless ZappFiles from any claims or liabilities arising from their use of the platform.

9. Force Majeure

ZappFiles is not liable for service disruptions caused by events beyond our control, including natural disasters, cyberattacks, or government actions.

10. Content Moderation & Reporting

Users may report content violations via our support channel. We reserve the right to remove content and suspend accounts in response to violations.

11. Responsible Disclosure Policy

Ethical hackers and security researchers can report vulnerabilities via our Responsible Disclosure Program.

12. Arbitration & Dispute Resolution

Any disputes will be resolved via binding arbitration, except for small claims court cases and intellectual property claims.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of California. Disputes will be handled in California courts, unless arbitration applies.

14. Legal Notices & Contact Information

Users will be notified of changes via email or posted updates. For legal inquiries, contact legal@zappfiles.com.

15. Termination & Account Deletion

Accounts inactive for 12 months may be deleted. Users can request account deletion via support.

16. Miscellaneous Provisions

  • Failure to enforce any part of these Terms does not waive our rights.
  • If any section is deemed unenforceable, the remaining provisions still apply.

By using ZappFiles, you acknowledge that you have read and agree to these Terms.
